    Say we were to take legal action against this DDoSer. What would happen if it was found out we were using pokemons stuff and got sued for that? Is that a possibility in this situation?

      IIRC Nintendo gave permission to use certain Pokemon resources.

      It's not illegal to make a pokemon fangame, unless you charge money for playing it I think. So unless she decides to sell the game, it's legal.

      Nintendo has been letting people to use their intellectual properties to make derivative works(fan games, let's plays, etc.) since last year. So no, I don't think Amethyst or anyone else would get sued for this.
