From what I understand, the devs were the ones who took the download links down after Nintendo asked.
I actually don't think Nintendo can do anything about fan games as long as they don't profit off the brand.

Yeah, but Nintendo should just let them do it. I mean, people are still going to buy their pokémon games. Having fan-games doesn't change anything!
